Terms of use for the public portal of the notification system for workers who are posted to Latvia
I. General terms
- The terms of use for the public portal (hereinafter Terms) of the notification system for workers who are posted to Latvia define the procedure for using the public portal of the notification system for workers who are posted to Latvia, as well as the rights, obligations, and restrictions of its users.
- The following vocabulary is used in these Terms:
- authentication – verification of the User's electronic identification data by the identification service provider;
- authorization – a process of determining the level of User privileges associated with NDPS system resources;
- digital service – a service that allows performing all or some of the actions necessary to provide the service, using information and communication technology;
- NDPS public portal – the NDPS portal, consisting of a public section accessible without authentication and a closed section accessible only by authorized users;
- User – a person who is using NDPS in accordance with the Terms;
- Supervisor – governmental institution that manages and organizes the operation of NDPS as per Regulations;
- Holder – an institution authorized by the system supervisor to maintain the functionality of the information and technical resources of the NDPS as well as ensure the information flow in accordance with the procedure laid down in regulatory enactments;
- The supervisor and holder of the NDPS is SLI.
- The Terms are mandatory for all the NDPS public portal users.
- SLI has the right to amend the Terms. Amendments to the Terms take effect from the moment of their publication on the main page of the NDPS public portal.
- The web address of the NDPS public portal is https://posting.vdi.gov.lv.
- The NDPS public portal is available 24 hours a day via Mozilla Firefox, Google Chrome, Opera, Microsoft Edge, and Safari web browsers.
- By accessing the NDPS public portal for the first time, users acknowledge that they have read the Terms and agree to abide by them.
- All disputes arising between the Supervisor and the User regarding the use of the NDPS public portal shall be resolved by mutual negotiations. If disputes cannot be resolved by negotiations, they shall be resolved in accordance with the normative legal acts of the Republic of Latvia.
II. User identification and authorization
- Users authorized in the NDPS public portal agree to share their personal data with the Supervisor.
- Users of the NDPS public portal can authenticate with:
- Single Sign-On Module provided by the State Regional Development Agency of the Republic of Latvia;
- username and password created by the User.
- Upon authentication, the User is redirected to a page where it is possible to electronically create and submit a new notification on the posting of workers to Latvia, as well as update a previously created notification.
- The contact information specified in the User account during registration is used for sending system notifications and alerts as a necessity.
III. User obligations and rights
- The User takes responsibility for all the actions within the NDPS public portal, including actions taken by third parties, if those third parties access the NDPS public portal with User's authentication credentials, obtained either with the User's permission or through the User's negligence.
- Users must provide their contact information in the NDPS system. It is the responsibility of the User to keep contact information up to date.
- The User undertakes to comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation); Personal Data Processing Law, and Freedom of Information Law when using the NDPS public portal and the information on natural persons' data available therein.
- The User has the following rights:
- receive Supervisor's consultations regarding the provision of information to the NDPS;
- submit proposals to the Supervisor for improving the usage of the NDPS public portal;
- be informed of any interruptions in the operation of the NDPS public portal (including the works related to NDPS maintenance and functionality improvements) and the expected timeline for restoration of service;
- get help with the questions regarding the operation of the public portal of the NDPS system by sending a message to the e-mail address supportposting@vdi.gov.lv, using the secure communication service E-address, as well as by calling the consultative line of the State Labour Inspectorate +371 67186522.
- The User is obliged to:
- use the information available on the NDPS public portal only for a legitimate purpose related to professional duties;
- immediately notify the Supervisor if there are suspicions of any actual or potential unauthorized access to the NDPS public portal;
- immediately notify the Supervisor if the User's access data is in the possession of other persons or if there is a risk of unauthorized use of the User's access data;
- exit the NDPS public portal by pressing the "LOG OUT" button after finishing work in the NDPS system.
- The User shall not:
- disclose User access credentials to other persons and take any action that may facilitate the disclosure of User access credentials to other persons;
- take any action aimed at circumventing or damaging the security mechanisms of the NDPS public portal;
- perform unauthorized copying of the data available within the NDPS portal or any fragment of the NDPS system itself;
- use the information available on the NDPS public portal for the creation of other information systems and data processing systems without written permission of the Supervisor.
IV. Rights and obligations of the NDPS supervisor
- The Supervisor is responsible for the administrative management and control of the system's users.
- The Supervisor owns the right to block the User's access to the NDPS public portal at any time in case of violation of the Terms or laws and regulations.
- The Supervisor is obliged to:
- ensure continuous system operation;
- manage NDPS technical resources;
- ensure ongoing coordination and monitoring of the implementation of the system security policy;
- manage audit trails and ensure protection against malicious software (computer viruses);
- disable system resources and suspend system operations if risks to information security - confidentiality, integrity, or availability are identified.
- The Supervisor cooperates with partner institutions: the State Regional Development Agency, and the Latvian State Radio and Television Centre, whose data is used in the operation of the system, by concluding mutual agreements on the receipt or exchange of data.
- The Supervisor responds to questions or complaints raised by the User regarding the errors found in the operation of the NDPS public portal and in the provision of the notification service for workers who are posted to Latvia.
